Terms of Service

You must be at least 18 years old and able to enter into a contract to use the Service. By using the Service, you confirm that you meet these conditions.

Akiba is a platform that connects merchants selling physical products with local micro-influencers. Traffic is generated through social networks such as TikTok, and sales conversations often take place via WhatsApp. Akiba provides tools to create storefronts, generate affiliate codes, manage affiliations and track commissions.

To use most features, you must create an account as a merchant or influencer. You are responsible for the confidentiality of your credentials and for all activity carried out under your account. You agree to provide accurate information and keep it up to date.

The Service lets merchants and influencers create affiliations and affiliate codes, and records the sales or commissions attributed to those codes. While Akiba provides tracking tools, the final commercial arrangements between merchants and influencers are their sole responsibility, and Akiba is not a party to them.

Many transactions take place directly between merchants, influencers and buyers, notably via WhatsApp or in a physical store. Akiba is not responsible for these transactions, payments, deliveries, product quality, or any disputes between users.

You retain ownership of the content you upload (product images, descriptions, etc.). You grant Akiba a non-exclusive, worldwide license to host and display this content for the purpose of operating the Service. You represent that you hold the rights necessary to upload and share your content.

You agree not to use the Service for illegal, fraudulent, infringing or harmful purposes; not to sell prohibited or counterfeit products; not to falsify affiliations or sales; and not to attempt to disrupt, scrape or gain unauthorized access to the Service.

The Service integrates with third parties such as TikTok, Google and WhatsApp. Your use of these services is subject to their respective terms and policies, over which Akiba has no control.

The Service is provided “as is” and “as available”, without warranty of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free or secure.

To the fullest extent permitted by law, Akiba and its operator shall not be liable for any indirect, incidental or consequential damages, or for any loss of profits, data or reputation arising from your use of the Service.

We may suspend or terminate your access to the Service at any time in the event of a breach of these Terms or use likely to cause harm. You may stop using the Service and request the deletion of your account at any time.

These Terms are governed by the laws of the Republic of Cameroon, without regard to conflict-of-law rules. Any dispute will fall under the competent courts of Cameroon, unless otherwise required by applicable law.

We may update these Terms from time to time. Significant changes will be indicated by updating the “Last updated” date. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
